Terms and conditions

By booking a room in the Estu-Casa Residence in Bogotá you accept the terms and conditions.

 

 Payments and deposit

  • Failure to pay on time will subject the guest to all related extrajudicial and pre-litigation costs, as well as all court costs.
  • Stichting BCMH only accepts payments via bank transfer, PayPal, ideal (upon request), or credit card (through PayPal, no account needed). Stichting BCMH reserves the right to refuse payment by bank cheque, cash, giro acceptance form or other means of payment, or to attach conditions to their acceptance.
  • Invoices must be paid in accordance with the agreed upon instalments. if a payment is not (fully) received, or is received late, a late payment fine of €25,- will be charged and access to the room will be blocked.
  • For stays of one month or more a deposit equal to one (1) month rent should be paid. If staying less than one month the deposit is equal to the total rent payable.
  • In the event the guest fails to live up to its payment obligation in time, Stichting BCMH reserves the right to terminate the stay of the guest with immediate effect. In such case, the payment obligation for the agreed term will continue unabridged and will be subtracted from the deposit.
  • Upon expiry of the tenancy agreement, the tenant will deliver the property let in same state as at the day of arrival. The tenant will hand over the keys to the landlord on the date of vacation.
  • During the last room cleaning before check-out, the room will also be checked to see if there needs to be carried out repairs and if the cost for the repairs will be paid by Stichting BCMH or by the guest.
  • Stichting BCMH will refund your deposit minus outstanding amounts. The refund will take place after handing back the keys to a staff member of Stichting BCMH.

 

Check-in procedure

  • Unless agreed otherwise by e-mail, we will make the room available to the guest at 3 p.m. on the check-in date. The check-out time for guests is 12 p.m.
  • Only the registered guest is allowed to make use of its booked room.

 

Cancellation policy

  • For a 100% refund, a full calendar month prior notice of cancellation is applicable. The proposed cancellation must be provided by email to info@estu-casa.com. If notice of cancellation is given less than one month prior to arrival the first month must be paid.
  • For cancellations during the stay also applies a full calendar month prior notice of cancellation and must be provided by email to info@estu-casa.com.
  • The tenancy agreement may be terminated with the joint approval of the tenant and the landlord at any time once the period of tenancy has commenced.

 

Terminating the rental agreement by Stichting BCMH

  • Stichting BCMH has the right to terminate its services towards the guest in case of violation of the terms & conditions. in such case, the payment obligation for the contracting party and/ or guest towards Stichting BCMH for the agreed term will continue unabridged for the remaining contract period.
  • In addition, the contracting party and/ or the guest will be financially liable towards Stichting BCMH for any other costs or loss of revenue resulting from the violation of the terms & conditions by the contracting party and/or the guest.

 

Liability Stichting BCMH

  • Guests are entirely responsible for the conduct and behavior of the people they bring into the Estu-Casa residence and will be liable for any damages or costs of the person(s) accompanying the guest.
  • Stichting BCMH accepts no liability for any harm or loss caused by persons or property that a guest has brought into the Estu-Casa residence or caused to be brought into the Estu-Casa residence.
  • Stichting BCMH accepts no liability for any harm or loss caused in respect of any persons and/or their property, including death, personal injury, property damage or theft.
  • Stichting BCMH will not accept liability of lost luggage, personal items, mail or delivered packages unless the guest can prove that these items were lost or stolen due to Stichting BCMH’s negligence.

 

Liability of the guest and/or contracting party

  • The guest or those accompanying the guest are jointly liable for all harm or loss that has been and/or will be inflicted upon the Estu-Casa residence and/or any third party as the direct or indirect consequence of misconduct, negligence and/or a wrongful act instigated by a guest and those accompanying guest.
  • This liability also applies in respect of harm or loss caused by any animals and/or any substance and/or any property held by or under the supervision of the guest and those accompanying the guest.
  • Stichting BCMH may file an official report with the local police if we observe misconduct, criminal acts or violations of the terms and condition.

 

The Estu-Casa residence

  • It is strictly forbidden to smoke inside the Estu-Casa residence.
  • The tenant is allowed to have one visitor for a maximum of one night without prior consent of the landlord. If a visitor stays for more than one night, prior consent of the landlord is necessary and a fee of 5 euros per night will be charged.
  • Drugs enforcement laws are as applicable in the Estu-Casa residence as anywhere else in Colombia. it is illegal to buy, sell or take any type of drugs. Stichting BCMH may file an official report with the local police if we observe a guest in the possession of drugs.
  • No parties allowed in the Estu-Casa residence.
  • No visitors allowed after 10:00 pm.
  • Guests are not allowed to make noise from 10:00 pm to 09:00 am.
  • No music allowed on the terrace.
  • Guests need to clean up the kitchen after use: clean their dishes and other utensils used, directly after using them.
  • Any guest staying at the Estu-Casa residence may be obliged to be transferred to another room of the same room type for operational reasons.
  • It is prohibited to sublet any type of room (either via airbnb, wimdu etc.). subletting a room will lead to direct termination of the rental contract and a fine of €350, -.
  • We do not permit pets on our premises.
  • Staff of Stichting BCMH has the right to enter the room of the guest for either maintenance or security reasons, or hygiene matters. This may be done without prior notice but notice will always be given where and when possible.
  • Any and all disputes or controversies arising out of or in connection with this lease, including the execution, performance or termination thereof, shall be finally settled under the rules of arbitration of the chamber of commerce of Bogotá by a one-member arbitral tribunal. Lessor and lessee shall together nominate the arbitrator. If the parties do not come to an agreement over the arbitrator, the chamber of commerce of Bogotá shall choose one from the A list of such entity. The arbitration shall be conducted in Spanish and in accordance with the rules and regulations of the chamber of commerce of Bogotá. Judgment shall be made in accordance to law.
  • In case of emergency guests can reach the fire brigade, police, and ambulance by calling the number 123 for free from their mobile phone.
